Traditionally, private and public enterprise in Malta have relied on insurance as the main source of risk management, comfortable in the belief that once they do what the insurance companies require them to do, and pay the premiums, the risk is totally covered. In this sense businesses have yet to learn how to take more responsibility in protecting the business against future negative events. This latter aspect is often financially motivated as executive management fail to see justification in going beyond the insurance stipulations. It is as if the overriding perception dictates that insurance is the be- alland- end- all of risk management strategies. Clearly this attitude is unsustainable in today?s business and operational environments.

The Malta Association of Risk Management ( MARM) was formed with the intention of establishing itself as the principal risk management body in the Maltese islands with an emphasis on raising awareness of the need for good risk management practice and reaching out to all sectors that potentially stand to benefit from the discipline. MARM seeks to present risk management as a complementary approach to mainstream management, which takes into account the potentially negative as well as positive outcomes of decision making.

Business managers at all levels must not expect risk management to solve bad management, nor will it make up for inadequate resources and poor decision making. Risk Management can, however, reduce the likelihood and consequences of events that might affect organisations from time to time. Most importantly, good risk management is also about identifying opportunities in risk and this is a very powerful idea in today?s interconnected world.

MARM will be formally launched during a half- day conference to be held at the Dolmen Hotel, Qawra on March 30. Jorge Luzzi, president of Ferma ( Federation of European Risk Management Associations) and group risk management director for Pirelli worldwide, executive director of Pirelli Insurance and Reinsurance Company in Dublin and managing director of Pirelli Group Reinsurance in Switzerland will be the keynote speaker.

The guest speakers will be Jack Kruf, president of Primo Europe, principal consultant with Acestes and former city manager of Roosendaal; Marie Gemma Dequae, scientific advisor to Ferma and a past president of the federation, who was recently appointed by the Belgian government as an independent director of Dexia Bank Belgium and its subsidiary Dexia Insurance Belgium; Carolyn Williams, head of thought leadership with the Institute of Risk Management ( IRM); and Guy Kurjian, president of the World Food Safety Organisation ( WFSO).

While these events are not the typical fare for Landa since joining Trigild last November, he has learned to expect the unexpected.

Landa recalled taking over one commercial property in Northern California where marijuana was being grown.

?Medical marijuana is legal at the state level, but it?s still illegal at the federal level so we had to abide by that,? Landa said, adding that the grower was booted off the property.

Landa said Trigild sometimes runs into surprises when inspecting an address.

?We found a brothel at a truck stop in the Northeast and found a dead body (apparently of natural causes) in a property in Kansas City ? ?We handle everything from these kinds of cases to apartments with bad neighbors to really nice hotels,? Landa continued.

?Trigild is really knowledgeable about what to do in these instances and they make my life really easy.?

Maybe not quite so easy. For example, in the case of a portfolio of 50 gas stations, he has the challenge of finding all the responsible parties to clean up the petroleum from leaking into underground storage tanks.

Landa must also remove legal obstacles to facilitate the resale of foreclosed hotel properties. One of the success stories was San Diego-based Pacifica Host Hotels?purchase of the 98-room Inn at Morro Bay on the Central California coast out of foreclosure. The hotel, which had roughly $14 million in debt, reportedly sold for about $9 million earlier this month.

With hotels, Landa notes it is necessary to deal with labor law, liquor licenses, amend existing franchise agreements and a host of other matters if the property is to be successfully transferred.

Trigild has especially become well known for its disposition of apartment properties. Most notable among these, which came before Landa?s time, was the Bethany Properties portfolio that consisted of seven Arizona apartment complexes comprising 2,759 units. Bethany literally walked away from the units, leaving tenants to fend for themselves.

?These complexes had a combined occupancy of about 40 percent,? Landa said.

Landa said he was pleased that Trigild had that occupancy to about 90 percent by the time an Arizona Superior Court judge approved the sale of the portfolio for $123 million to Standard Portfolio last August. What?s more, the court was so assured that it allowed Trigild to go directly to the sale rather than having to navigate the foreclosure process.

While he wasn?t personally involved with the Bethany case, Landa said cases like it are the reason he took the job with Trigild.

?It?s a fascinating line of work ?? Landa said. ?You just jump in with the leasing issues, repairs and maintenance.?

Along with handling completed projects, Landa noted that Trigild is called into finish incomplete jobs. Despite a few very unusual cases, Landa is just as comfortable in real estate as he is in the legal world.

Prior to practicing law, Landa was an associate at the London Group Realty Advisors, providing strategic consulting and financial analysis services for real estate developers and investers throughout the United States and Mexico, and was also a public policy analyst at the San Diego Regional Economic Development Corp.

Landa was previously an associate with Hecht Solberg Robinson Goldberg & Bagley LLP, a leading San Diego real estate law firm, where he was involved in the acquisition, development, financing, leasing and disposition of residential and commercial real estate assets. He also possesses significant litigation experience, including alternative dispute resolution and trial work.

As general counsel, Landa provides legal and strategic expertise to company management. In this capacity, he develops and negotiates real estate contracts, represents Trigild in judicial proceedings, serves as receiver and provides guidance on a wide variety of corporate and real estate issues.

Landa said he is involved in sales and leasing work, due diligence, probate, the liquidation of assets and a variety of consulting roles as well as acting as a receiver.

At Trigild, Landa oversees a 10-person legal department that includes five paralegals and said that they are hiring more staff.

Landa notes that Trigild is still seeing a tremendous amount of distressed property during its day-to-day operations.

?Commercial real estate is going to get worse over the next two years. We keep getting busier,? he continued.

Landa says the good news is commercial real estate buyers, whether individual investors or giant real estate investment trusts, are returning to the market.

Protein researchers unravel the molecular dance of DNA repair

Using state-of-the-art technology, scientists at the Novo Nordisk Foundation Center for Protein Research at the University of Copenhagen and their international collaborators have successfully obtained "molecular snapshots" of tens of thousands processes involved in DNA damage repair. On a daily basis this restoration keeps cells healthy and prevents the development of cancer. The results of this study will help unravel exactly how cells repair their broken DNA, how chemotherapy affects cells? workings and will assist in the discovery of new drugs with fewer side effects.

"DNA repair is vital in keeping cells healthy," Associate Professor Chunaram Choudhary from the Novo Nordisk Foundation Center for Protein Research says.

"So unraveling the molecular details of how a cell communicates when its DNA is broken will help us understand how cells protect their genomes."

"We know, for example, that chemotherapy kills cancer cells by damaging their DNA," postdoc Petra Beli explains.

"This happens because the fast growing cancer cells are more sensitive to DNA damage than healthy cells. However, how exactly chemotherapy works on a cellular level is still a mystery. Once we understand the molecular consequences of chemotherapy on cancer cells, we could begin to work on ways to protect healthy cells during treatment of patients with cancer."

Daily DNA damage threatens healthy cells

Everything from sun tanning to environmental factors and normal metabolic processes inside the cell damages the DNA of that cell every day. This in turn can lead to production of faulty proteins that - if not repaired - could go on to become the driver of cancer development.

To prevent these devastating effects, damaged DNA triggers an elaborate alarm system, which sets of a chain reaction in the cell, to slow processes, terminate others and wait, while legions of molecules go to work on the damaged DNA.

"Identification of proteins that are crucial for repairing broken DNA may help find new drug targets, and by using such very specific drugs it may also become possible to minimize the side effects, which occur when a drug hits too broadly in the body," Chunaram Choudhary continues.

Much remains to be learned

DNA repair has been studied intensely for years, but Associate professor Choudhary and his group at the Department of Proteomics along with his collaborators from University of Cambridge and Max Planck Institute are the first to unravel tens of thousands of molecular signaling events involved in this complex process.

"We first damaged the DNA of cells using radiation or chemical drugs and then used a technique called mass spectrometry, which is a way of precisely determining the identity of proteins and their chemical modifications," Petra Beli says.

"This allowed us to follow thousands of protein modifications that happened in the process of DNA repair, shedding new light on how the networks of biochemical signals are regulated and how the infrastructure of alerts works."

The data from the experiments is so extensive that it will require much further work by researchers to fully understand the significance and impact of these newly identified signaling pathways. But investors including Colony Capital, Ron Tutor and the investment arm of Qatar had already withdrawn the majority of their equity in a refinancing last year that added more than $500 million in debt. New distribution deals are expected to bring in $325 million in revenue over time.

Last year, Miramax released three movies that came with the purchase from Disney, including "The Debt," starring Helen Mirren and Jessica Chastain.

The executive change suggests a ramp-up to become a full-fledged studio, a sale, or more of the same just under new leadership.

Lang said he will remain with Miramax as a consultant until a successor is found.

"The value of the Miramax film library and its iconic underlying brand is clear and the future is bright," Richard Nanula, chairman of Miramax and a principal at Colony Capital, said in a statement.

Miramax's chief financial officer, Steve Schoch, will serve as interim chief executive.

Afghanistan's Karzai lashes out at U.S. over massacre

KABUL (Reuters) - Afghan President Hamid Karzai on Friday accused the United States of failing to fully cooperate with an investigation into the massacre of 16 Afghan villagers by a U.S. staff sergeant and questioned whether only one soldier could have been involved.

A series of blunders by the United States, including the killings in Kandahar province on Sunday and the inadvertent burning of copies of the Koran at a NATO base last month, has further strained already tense relations between the countries.

"The army chief has just reported that the Afghan investigation team did not receive the cooperation that they expected from the United States. Therefore these are all questions that we'll be raising, and raising very loudly, and raising very clearly," Karzai told reporters at his palace.

Flanked by senior officials, Karzai met with village elders and the families of victims of the massacre, and dressed somberly in black for the start of two days of talks to discuss the killings.

Karzai appeared to back the belief of the villagers that one gunman acting alone could not have killed so many people, and in different locations some distance apart.

"They believe it's not possible for one person to do that. In his family in four rooms people were killed, women and children were killed, and they were all brought together in one room and then put on fire. That, one man cannot do," Karzai said.

With several investigations still underway by both U.S. and Afghan officials, any discovery of more than one soldier involved in the incident would be a disaster for NATO, with Western leaders needing to win over Afghans ahead of a withdrawal by most foreign combat troops in 2014.

On Thursday, Karzai called for NATO troops to leave Afghan villages and confine themselves to major bases, underscoring fury over the massacre and clouding U.S. exit plans.

He also demanded the handover of security to Afghan police and soldiers by 2013, a year ahead of schedule.

Such a move could undercut U.S. President Barack Obama's strategy for Afghanistan and hamper efforts to mentor Afghan police and help with local governance.

The soldier accused of carrying out the shooting was attached to a small special forces compound similar to others around the country which underpin NATO's anti-insurgent strategy.

Karzai has slim room for maneuver in a war that has tested both his presidency and that of his U.S. counterpart, Obama.

Installed by the United States as interim leader after U.S.-backed Afghan forces toppled the Taliban regime in 2001, he has to walk a line between growing public anger over the presence of Western troops and Washington's support of his government.

In a blow to NATO hopes of a negotiated end to the decade-old war, the Afghan Taliban said they were suspending nascent peace talks with the United States, following the massacre.

The U.S. government said it remained committed to political reconciliation involving talks with the Taliban but progress would require agreement between the Afghan government and the insurgents.

Suspected tornado hits Michigan as warm spell goes on

CHICAGO (Reuters) - A suspected tornado touched down in Michigan on Thursday, causing severe damage to some structures but no deaths, as forecasters put four states in the country's midsection under severe thunderstorm watches or warnings.

A dispatcher with the Washtenaw County Sheriff's Department said "there are homes leveled at this point" in Dexter, just north of the Michigan college town of Ann Arbor.

Local TV stations posted images of what appeared to be a funnel cloud bearing down on the town, as jitters remained high in tornado country two weeks after a chain of fast-moving twisters spawned by massive thunderstorms killed dozens of people, mostly in Indiana and Kentucky.

Much of southeast Michigan was under either a severe thunderstorm warning or watch, after a tornado warning for parts of Washtenaw County expired before 8 p.m. local time, the National Weather Service said.

Parts of Indiana, Kentucky and Tennessee were also under a severe storm watch on Thursday, with forecasters warning of wind gusts of up to 70 miles an hour and dangerous lightning.

The severe thunderstorm warnings came as much of the country east of the Rocky Mountains enjoyed yet another day of unseasonably high temperatures. Forecasters at Accuweather.com said that warm air was helping to fuel Thursday's storms.

"It's just so warm that we're seeing thunderstorms pop up like popcorn the way you see it in the summertime," said Dave Samuhel, a meteorologist at Accuweather.com.

The biggest risk from the storms was of large hail and damaging winds, but the Weather Service warned that severe thunderstorms "can and occasionally do produce tornadoes."

New record highs for the day were set from Macon, Georgia, to Madison, Wisconsin, to Sioux Falls, South Dakota.

In Madison, where the previous high for March 15 was 69 degrees, temperatures reached 81 degrees on Thursday.

"They just destroyed that record," Samuhel said. "We're seeing a lot of that in Wisconsin."

In Chicago, the official temperature at O'Hare International Airport on Thursday afternoon was 79 degrees, 5 degrees above the previous record for the day, and Indianapolis topped out at 80 degrees, 3 degrees above the previous record.

Accuweather.com said the unseasonably warm weather west of the Plains would continue into next week and spread further east into places like New York City, where residents were experiencing a more typical spring day on Thursday as winds out of the northeast kept daytime highs in the 40s.
