Mexico nabs alleged Zetas local chief, 5 others (AP)

MEXICO CITY ? The Mexican navy said Wednesday it had arrested the alleged local chief of the Zetas drug cartel in the Gulf coast port of Veracruz, and said he is tied to the dumping of eight bodies in a rural town a week ago.

The navy said Carlos "The Bam Bam" Pitalua and five other men were arrested on Tuesday. One of the five is suspected in helping break 32 inmates out of three Veracruz prisons in a well-planned, simultaneous escape.

A picture released by the navy shows four of the six dressed in military clothing.

One day after the jail break, gunmen dumped 35 bodies on a busy avenue of Veracruz last month. Some of the victims were reported at the time to have been escaped inmates.

And in central Mexico State, outside Mexico City, prosecutors announced Wednesday they had arrested Adrian Ramirez, alias "The Mushroom," the alleged leader of the Cartel del Centro.

The gang is believed to be one of the spin-off groups from the Beltran Leyva cartel, which has been decimated by the arrests or deaths of its leaders.

Mexico state Attorney General Alfredo Castillo said the Cartel del Centro has been linked to at least 26 killings, and operated mainly in Mexico City suburbs.

The suspects were arrested last week, Castillo said.

Finally, Mexico's National Public Safety System announced that almost one-third of 63,436 low-ranking Mexican police officers tested so far have failed background and security checks.

Almost one-quarter of the police chiefs and top commanders tested so far have also failed, as had about 10 percent of midlevel police commanders and officers. The agency said in a statement that all those who fail the vetting process should be fired, but left open the possibility that some might be reassigned.

Mexico has set a goal of vetting all of its police by the end of 2012. However, only 71,079 have been tested so far, equal to about 18 percent of the total police force of 431,739 officers.

Nokia proclaims new dawn with Windows phones (Reuters)

LONDON (Reuters) ? Nokia unveiled two sleek new Microsoft Windows phones on Wednesday in time for Christmas, a first step in the ailing cellphone maker's fightback against Apple and Google.

Chief Executive Stephen Elop presented the two new smartphones, the first fruits of his big bet on Microsoft software, to a 3,000-strong audience in London, saying they represented the beginning of a new era for the Finnish giant.

"It's a new dawn for Nokia," Elop said as he unveiled the high-end Lumia 800 and mid-range Lumia 710, which will go on sale in key European markets next month.

In an interview with Reuters, Elop said the world's biggest cellphone maker had transformed itself during his 13-month tenure, which has seen a shake-up of senior management and thousands of lay-offs.

"It is a different company operating on a different clock speed," he said. "The amount of effort and passion and work that's been accomplished that we were able to show off today is the best evidence of that."

Nokia shares, which have halved in value since Elop announced his high-risk partnership with Microsoft and ditched its old software platform in February, were up 3.1 percent at 1323 GMT, outperforming the wider market.

Elop said the new phones' minimalist design and superior navigation features would make them stand out among rival Windows phones, some of which have been faster to market with Microsoft's new Mango mobile platform.

Christian Lindholm, a partner at design agency Fjord who formerly managed Nokia's classic S60 and S40 user interfaces, said the new phones showed a renewed confidence in Nokia's traditional strengths.

"They're getting back to their roots -- simplicity," he said. "They've stripped out the noise and focused on what people need to communicate, navigate and socialize."

Analysts were positive about the new phones, though they said the first results of the Nokia-Microsoft pairing remained well short of an iPhone killer.

"These devices are a good start, but the reality is that they are pretty much plain vanilla Windows Phone products," said Ben Wood, director of research at UK-based telecoms analysis firm CCS Insight.

"The real fruits of Nokia's and Microsoft's labors will come next year ... but it remains a Herculean task to recapture this lucrative market from Apple and (Google platform) Android."

The Lumia 800, with vivid colors and a curved, black display, features Windows Phone's live icons on the home screen, which automatically update news, weather and Facebook feeds.

It also boasts free navigation and Microsoft's new Internet Explorer 9 browser, and will sell for about 420 euros ($584) excluding taxes and subsidies, putting it in the same bracket as Apple's iPhone and Samsung's top Galaxy phones.

The Lumia 710 will sell for about 270 euros.

"The Lumia phones do have some strong selling points in their own right ... and they offer a look and feel that's radically different from anything seen previously on a Nokia device," said John Delaney, research director at technology research firm IDC.

HERCULEAN TASK

Nokia has suffered most in recent years in the United States, where operators have spurned its offerings in favor of the iPhone and popular Android models such as the Motorola Droid.

Elop said the company planned a portfolio of new products for the U.S. market early next year, and said Nokia did have U.S. carrier support.

In Europe, Nokia has launched the new phones with the support of 31 operators and retailers, which will help push the phones into the hands of consumers and secure subsidies.

Microsoft's mobile platform has a market share of just 2-3 percent, compared with Android's near 50 percent and Apple's 15 percent of the smartphone market.

Analysts and developers said Microsoft's platform was emerging as the third player at a fortuitous time, when Google's planned $12.5 billion offer for Motorola Mobility was creating uncertainty among other Android phone makers.

"They got really lucky. There is a lot of confusion in the Android marketplace now," said Carolina Milanesi, analyst with technology research firm Gartner.

Elop said it was an open question as to how much disruption the Google-Motorola deal would have, but said any indication of problems should help.

"I think that any confusion or questions in the other ecosystems can be something that can be an advantage to the Windows Phone," Elop told Reuters.

The phones will go on sale in France, Germany, Italy, the Netherlands, Spain and Britain in November, and in Hong Kong, India, Russia, Singapore and Taiwan before the end of the year.

Nokia also unveiled four new basic phones for emerging markets, where it still holds a leading position.

Nokia's third-quarter results beat low expectations, sparking hopes that the company can survive a painful revamp, but smartphone sales still dropped 38 percent from a year ago.

The annual Nokia World media and industry event in London, where the launch took place on Wednesday, includes speakers from the world's largest carriers, China Mobile, Vodafone, Orange and MTN.

Nurse: Jackson said only propofol let him sleep

A sometimes tearful nurse testified Tuesday that her efforts to save Michael Jackson from the drug he craved for sleep were rebuffed by the star, who insisted he needed the powerful anesthetic that eventually killed him.

Cherilyn Lee, who tried to shift Jackson to holistic sleep aids in the months before he died, said the singer told her Dipravan, a brand name for propofol, was the only thing that would knock him out for the sleep he needed. He told Lee he had experienced the drug once during surgery.

Lee almost didn't testify. She sat down in the witness box then said she felt dizzy, before starting to cry.

"This is just very sensitive for me," she said.

Lee told of coming into Jackson's life at the beginning of 2009 and leaving just before Dr. Conrad Murray arrived. Murray has pleaded not guilty to involuntary manslaughter and is accused of giving Jackson a fatal dose of the drug Lee would not give him.

Lee recalled a meeting with the superstar at his rented mansion two months before his death.

"He was sitting very close to me," she said. "He looked at me and said, 'I have a lot of difficulty sleeping. I've tried a lot of things and I need something that will make me fall asleep right away. I need Dipravan."

Lee had never heard of the drug but did research and later told Jackson it was too dangerous to use in a home.

At one point she asked: "What if you didn't wake up?"

Jackson, however, was adamant the drug would be safe if he had a doctor who could monitor him while he slept.

Prosecutors claim Murray abandoned Jackson after administering the fatal dose of propofol and failed to have proper lifesaving and monitoring equipment on hand.

Lee was called to the stand by Murray's defense, but the impact of her testimony was mixed.

While she supported a defense theory that Jackson was doctor shopping in a desperate search for someone to give him propofol, a prosecutor seized on her warning to show Murray should have known the dangers too.

Lee said her final refusal to provide the drug came on April 19, 2009, and she never saw Jackson again.

Another medical witness, Dr. Allan Metzger, testified Monday that Jackson also implored him to provide the anesthetic. Metzger also refused and instead gave the singer sleeping pills that had proven effective in the past.

Attorneys for Murray are trying to show that Jackson was a strong-willed celebrity who became the architect of his own demise. They also alleged he gave himself the fatal dose after Murray left his bedroom.

Lee said she had treated Jackson as he prepared for his planned series of "This Is It" comeback concerts.

Lee was followed to the witness stand by Randy Phillips, president and CEO of concert promoter AEG Live.

Defense attorneys had wanted to ask Phillips about Jackson's contract to show that Jackson would have owed $40 million to the promoter if the concerts were canceled. The lawyers said Jackson would be desperate to make sure the shows continued and needed sleep to get through his rehearsals.

Superior Court Judge Michael Pastor blocked that request and said allowing testimony about the contract might confuse jurors.

"This is not a contractual dispute. This is a homicide case," Pastor said.

Saudi cleric offers cash for Israel soldier kidnap (Reuters)

DUBAI (Reuters) ? A prominent Saudi cleric has offered to pay $100,000 to any Palestinian who kidnaps an Israeli soldier, according to his Facebook page.

Awad al-Qarni said he had made the offer in response to a similar reward promised by an Israeli family for anyone who catches the person who killed one of its members in 1998, following the exchange this month of more than 1,000 Palestinian prisoners for the captive Israeli soldier Gilad Shalit.

"The media reported the news of the Zionist occupiers paying a huge sum to anyone who killed the freed Palestinian prisoners," Qarni, who is well known in Saudi Arabia for his outspoken views but is not part of the official clerical establishment, said on his Facebook page.

"In response to those criminals, I announce to the world that I am committed to pay a $100,000 prize to any Palestinian inside Palestine who takes an Israeli soldier captive to exchange with (remaining) prisoners."

Qarni told Al Arabiya television that he had received wide support on his Facebook page and elsewhere.

"We have also received letters from ... groups from Arab countries. So the issue is not limited to Qarni, who was just the person who launched this initiative," he told the station by telephone.

Saudi Arabia, the birthplace of Islam, sees itself as a champion of Palestinian rights but Saudi leaders have been at pains to curb more radical statements by Muslim clerics on the Israeli-Palestinian conflict.

In 2002, the Western-allied kingdom floated a peace initiative calling for full Arab recognition of Israel if it gave up all lands occupied in a 1967 war and accepts a solution for Palestinian refugees.

Obama: No decision on oil pipeline from Canada (AP)

DENVER ? President Barack Obama said Wednesday his administration has made no decision on whether a Canadian company can proceed with plans for a transnational oil pipeline to Texas.

A protester during Obama's appearance at the University of Colorado Denver yelled out that the president should say no to the contested Keystone XL project.

Obama said his administration was looking into the issue but had made no decision. He told the protester: "I know your deep concern about it. We will address it."

Obama's comments came as a State Department official hinted that a decision on the pipeline may be delayed until next year. Officials have pledged to decide by the end of the year. The State Department has jurisdiction over the pipeline because it crosses an international border.

A senior State Department official, who asked not to be identified because the department was still reviewing the project, said, "While we are working towards a timely decision by the end of the year, our foremost commitment is to a thorough review and assessment of information and to make a decision based on the best available data and analysis."

The proposed pipeline has prompted protests nationally and demonstrators have been arrested in front of the White House. Demonstrators protested outside one of Obama's fundraisers Tuesday in San Francisco.

The pipeline would carry oil derived from tar sands in Alberta, Canada, to refineries in Houston and Port Arthur, Texas. The 1,700-mile pipeline would travel through Montana, South Dakota, Kansas, Nebraska, Oklahoma and Texas.

In a related development, 13 Democratic lawmakers and a Democratic-leaning independent sent a Wednesday letter requesting that the State Department inspector general investigate the department's handling of the pipeline application.

Sens. Bernie Sanders, I-Vt., Ron Wyden, D-Ore., and Sheldon Whitehouse, D-R.I., along with 11 House members, said they were disturbed by media reports that a company that performed an environmental review on behalf of the State Department had listed pipeline developer TransCanada as a "major client."

The lawmakers asked the inspector general to look at all contractual or financial relationships between the consultant, Houston-based Cardno Entrix, and TransCanada.

They also asked for a review of State Department emails involving a TransCanada lobbyist who had worked in Secretary of State Hillary Rodham Clinton's 2008 presidential campaign.

Clinton told The Associated Press earlier this month that she had "no reason to believe" there was a conflict of interest involving the TransCanada lobbyist, Paul Elliott.

The underground pipeline would carry an estimated 700,000 barrels of oil a day, doubling the capacity of an existing pipeline from Canada.

Supporters say the line could significantly reduce U.S. dependence on Middle Eastern oil, while opponents say it would bring "dirty oil" that requires huge amounts of energy to extract and could cause an ecological disaster in case of a spill.

Cholesterol Conundrum

Most people who are even a little bit concerned about their cholesterol know that there is a ?good? kind?known as HDL?and a ?bad? kind?known as LDL. Research has shown that the higher the amount of HDL and the lower the amount of LDL in the blood, the less likely a person is to suffer a heart attack or stroke. As for the one in six Americans with unhealthy cholesterol levels, well, they can always hope to change their luck with a cholesterol-changing medication or two. Or can they?

Two major clinical trials in the past three years have greatly complicated the picture for these and perhaps other folks. The first study, from 2008, shows that lowering LDL levels does not always decrease the risk of having a heart attack. Similarly, results from the second study, released in the spring of this year, show that raising HDL levels does not always translate into fewer heart attacks or strokes.

These perplexing findings do not mean that people should stop taking their cholesterol drugs. The results have, however, underscored the danger of indulging in a common logical shortcut in medical thinking?assuming that artificially producing normal test results in a patient is the same as conferring good health on that patient. For one thing, drugs typically do not mimic normal conditions perfectly. For another, heart attacks and strokes occur after a complex series of processes that may take years to unfold. Simply altering one of these processes does not necessarily fix the whole problem.

Good vs. Bad Cholesterol
Still, researchers and physicians, knowing the roles of LDL and HDL in the body, had good reasons to suspect that manipulating the levels could protect against heart attacks and strokes. Despite its bad reputation as a clogger of arteries, the cholesterol molecule is an irreplaceable component of many key parts of the body, from cell membranes to sex hormones. Indeed, this fatty, waxy substance is so important to life that evolution has produced several different mechanisms for transporting it through the bloodstream. Just as oil and water do not mix, neither do waxy cholesterol and watery blood, so cholesterol needs a kind of protective vehicle to surround it and carry it around the body. Two of the most important vehicles for the job are LDL (low-density lipoprotein), which delivers cholesterol to the various cells of the body, including the walls of arteries, and HDL (high-density lipoprotein), which removes cholesterol from the blood. HDL may also act as an antioxidant that reduces unhealthy inflammation in the arteries.

The trouble begins when too much LDL-carried cholesterol winds up in the arterial lining and contributes to the buildup of fatty material, or atherosclerotic plaque. Much of the time the plaque stabilizes without creating too many immediate problems, but sometimes it bursts, triggering blood clots that lead to heart attacks and strokes if the clots prevent blood from delivering critical oxygen to heart or brain tissue. Without oxygen, the affected tissue dies.

People with high LDL levels may form arterial plaques that are more likely to burst. Some people develop extremely high LDL levels because of a genetic disease called familial hypercholesterolemia that severely limits their ability to clear cholesterol from their blood. They suffer heart attacks in their thirties or forties, which is several decades earlier than the average for the general population. On the positive side, those who maintain normal cholesterol levels (LDL less than 100 milligrams per deciliter of blood and HDL cholesterol levels greater than 40 mg/dL) throughout their life without medication are much less likely to suffer heart attacks or strokes.

A Shortcut in Logic
With all this evidence linking cholesterol levels to heart disease risk, it is no wonder that researchers in general and pharmaceutical companies in particular reached a fairly straightforward, if simplistic, conclusion: anything?such as a medication?that reduces LDL levels and raises HDL levels must also reduce heart disease risk. By the 1980s the drug industry began marketing a whole family of cholesterol-lowering drugs called the statins, which work by blocking a liver enzyme that is essential for forming cholesterol. Clinical studies proved that statins do in fact reduce the number of heart attacks in people with high cholesterol. But is it the medications? cholesterol-lowering effect or some other aspect of how the drugs affect the body?such as its anti-inflammatory properties (inflammation is strongly suspected of contributing to atherosclerosis)?or even a combination of both that does the trick?

ROME (Reuters) ? Italian Prime Minister Silvio Berlusconi presented European leaders on Wednesday with a hastily constructed package of economic reforms in response to an ultimatum demanding action to boost growth and cut Italy's huge public debt.

It was not clear whether the leaders meeting in Brussels, who are highly skeptical about Berlusconi's ability to deliver, would be satisfied by a series of promises of future measures to get Italy out of the firing line in the euro zone debt crisis.

Polish Prime Minister Donald Tusk told reporters in Brussels before the summit that the letter had made a good impression.

Berlusconi, in political trouble at home, had been caught between the EU ultimatum and the refusal of his Northern League partners in a center-right coalition to make more than slight concessions on pensions -- a key plank of the reform program.

A "letter of intent" carried by Berlusconi to the summit, and seen by Reuters, promised a much delayed economic development plan by November 15 and a series of other measures to boost growth and ensure the budget is balanced by 2013.

They included a commitment to raise the pension age to 67 by 2026, and steps to cut red tape and improve conditions for business.

Berlusconi's political position is so weak he has little room for maneuver. The 75-year-old premier, badly weakened by sex scandals, corruption charges and political setbacks, made no comment to reporters as he arrived for the summit.

Initial market reaction to a minimalist pension deal with League leader Umberto Bossi was not encouraging, with Italy paying the highest yield in more than three years on six-month treasury bills at an auction on Wednesday.

FIGHTING IN PARLIAMENT

Tensions over the reform program broke into the open in Italy's parliament, where opposition and government deputies exchanged blows and the sitting was suspended.

President Giorgio Napolitano and incoming European Central Bank governor Mario Draghi warned that Berlusconi's promises must be followed by resolve to take painful measures to dig Italy out of a deepening economic crisis by cutting massive public debt and boosting stagnant growth.

The head of Italy's biggest retail bank, Intesa Sanpaolo, said he was disappointed by the sketchy agreement reached between Berlusconi and Bossi on Tuesday, which provided for only a slight acceleration in raising the pension age from 65 to 67.

"In the situation we are in, I expected an economic program that would be agreed by everyone and not just unconfirmed suggestions to take to Europe. I am disappointed," Corrado Passera told reporters.

Bossi refused point blank to agree to a more significant reform abolishing a system under which workers can retire early if they have paid 40 years of pension contributions.

An Italian diplomatic source told Reuters the summit's final communique would specifically mention Italy.

The letter outlines Italy's plan for reforms demanded by the EU as a condition for ECB buying of its bonds -- vital to prevent Italy being overwhelmed by debt repayments.

Incoming ECB chief Mario Draghi said ideas outlined in Berlusconi's letter must be implemented rapidly. Draghi, who is leaving Italy's central bank to take up the new role, said the situation in Italy was "confused and dramatic."

Napolitano, who has regularly worked closely with Draghi to try to stave off economic disaster in Italy, said in a speech in Belgium that anybody who wanted to govern the country must grasp the nettle of unpopular economic reforms.

"We can no longer dither over the categoric imperative of making a consistent and constant effort to lower our debt," he said.

DEBT MOUNTAIN

The euro zone's number three economy is at the center of the debt crisis. It needs to issue over 600 billion euros in bonds in the next three years to refinance maturing debt.

Berlusconi's office denied he had made a secret agreement with Bossi to resign at the end of the year but the League leader said he was pessimistic about the coalition's survival.

Analysts say Berlusconi is unlikely to last beyond December or January and elections are expected in spring, a year ahead of schedule.

Berlusconi has until now repeatedly said he expects to serve out his term until 2013. But reports are circulating that, caught between demands for action on the economy and the obstinacy of the League, he may throw in the towel sooner.

Analysts say neither the League -- where Bossi's leadership is also under threat from within -- nor Berlusconi's PDL party wants a government crisis before the end of the year because that might tempt Napolitano to appoint a stop-gap government of technocrats to pass urgent reforms.

A delay would enable the center-right to keep control of the way the crisis plays out ahead of elections in the spring.

The center-left opposition is also in disarray and is thought to be reluctant to take responsibility at this point for highly unpopular austerity reforms.

Italy has a public debt of 1.9 trillion euros, equal to 120 percent of GDP, second only to Greece in the euro zone.

The impatience of euro zone leaders at Berlusconi's repeated procrastination is sharpened by fears that a major debt crisis in Italy -- much bigger than Greece and too big to bail out -- would threaten the entire European project.

Economy Minister Giulio Tremonti has promised a package of reforms that would open up closed professions, cut red tape and raise revenue through steps such as privatizations and a new wealth tax, but the measures have been repeatedly delayed.

SeaWorld accused in suit of enslaving captive orcas (Reuters)

SAN DIEGO (Reuters) ? An animal rights group has sued SeaWorld accusing the chain of aquatic theme parks of violating the rights of captive killer whales under the 13th Amendment of the Constitution, which abolished slavery.

The lawsuit, filed late on Tuesday in U.S. District Court in San Diego, lists five performing orcas at SeaWorld's parks in California and Florida -- Tilikum, Katina, Corky, Kasatka and Ulises -- as plaintiffs in the complaint.

"All five of these orcas were violently seized from the ocean and taken from their families as babies," Ingrid Newkirk, president of People for the Ethical Treatment of Animals (PETA), said in a statement.

"They are denied freedom and everything else that is natural and important to them while kept in small concrete tanks and reduced to performing stupid tricks," she said.

SeaWorld San Diego responded with its own statement saying PETA's efforts to "extend the Thirteenth Amendment's solemn protections beyond human beings is baseless and in many ways offensive."

The park, the first of three established by SeaWorld Parks & Entertainment, added that displaying the marine mammals in captivity educates the public about the creatures.

David Steinberg, a professor at the Thomas Jefferson School of Law in San Diego, characterized as "patently, absolutely frivolous" PETA's claims that whales are entitled to protection from involuntary servitude under the 13th Amendment, ratified in 1865.

"The 13th Amendment abolished the abhorrent, despicable practice of the slavery of human beings," he told Reuters. "PETA is demeaning the integrity and humanity of people who were owned as slaves. That is outrageous."

The lawsuit seeks a court order requiring SeaWorld to release the five killer whales to a "suitable habitat."

Four of the orcas were caught in the wild off the coast of Iceland and a fifth was captured off the Pacific Northwest, the suit says. One of the whales, Tilikum, killed a trainer in Orlando last year by dragging her underwater.

The suit lists PETA and two former SeaWorld employees who have become activists opposing the captivity of marine mammals as "next friends" bringing suit on behalf of the whales.

PETA has undertaken a number of controversial actions in the past in seeking to advance the cause of animal rights.

Last year, a PETA member struck a Canadian government minister in the face with a pie to protest seal hunting. In 2003, the Anti-Defamation League accused PETA of trivializing the deaths of Jews in World War Two with a campaign that compared the meat industry to the Holocaust.

Virginia-based PETA's profile has risen in recent years with its "I'd Rather Go Naked Than Wear Fur" campaign, which has enlisted celebrities to pose nude for the group.
